Mediator Role and Neutrality

A mediator is a neutral third party who facilitates communication and negotiation between disputing parties to help them reach a voluntary settlement. The mediator does not represent any party, does not advocate for any outcome, and does not render legal advice or legal opinions during or outside of the mediation process. Each party to a mediation is strongly encouraged to consult with their own independent attorney before, during, and after the mediation process.

No Mediator-Party Relationship

Visiting this website, reading its content, sending an email, submitting the contact form, or leaving a voicemail does not create a mediator-party relationship between you and Rouviere Mediation. A formal mediator engagement is established only after:

• Andre A. Rouviere conducts a conflict-of-interest check in accordance with the Florida Rules for Certified and Court-Appointed Mediators
• All parties to the dispute have agreed to mediation
• Engagement terms have been confirmed in writing
• Any required deposit or fee arrangement has been finalized

Until all of these steps are completed, no mediator engagement exists, and Rouviere Mediation has no obligation to take any action on your behalf or to maintain confidentiality of communications under mediation privilege.

Confidentiality of Communications

Communications sent through this website, by email, or before a mediation engagement is established are not protected by mediation confidentiality under Florida Statutes Chapter 44 or related law. Do not send confidential, sensitive, or time-critical information through this website. If your matter is urgent or involves a deadline, call the office directly at (305) 774-7000 and speak with us before relying on any electronic communication.

Once mediation is formally engaged, communications and disclosures made during the mediation process are protected from disclosure as provided by Florida Statutes §44.405 and the Florida Rules for Certified and Court-Appointed Mediators, subject to the exceptions specified in those rules.

Every mediation turns on its own unique facts, the willingness of the parties to negotiate in good faith, applicable law, and circumstances. Outcomes vary based on factors no mediator can control.

Andre A. Rouviere is a Florida Supreme Court Certified Circuit Court Mediator authorized to mediate civil matters in all judicial circuits of the State of Florida. Mediation services are provided in accordance with Florida Statutes Chapter 44 and the Florida Rules for Certified and Court-Appointed Mediators promulgated by the Supreme Court of Florida.
